Terms and Conditions for Tips Payer

RESTOBOT Digital Tipping Service

Important clauses

RESTOBOT registered in Warsaw, Poland, NIP 1133092409, REGON 524951267, email [email protected] (“RESTOBOT,” “we,” or “the Operator”), operates a software platform (“Platform”) that allows guests of partner restaurants, cafes, bars, and other hospitality venues (“Venues”) to leave voluntary cashless tips directly to a Venue’s staff member (“Worker”) by scanning a QR code or following a payment link displayed at the Venue (“Service”). These Terms and Conditions (“Terms”) explain how the Service works and set out your rights and obligations when you use it. Please read them before leaving a tip, because THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND RESTOBOT. By clicking “Pay,” “Tip,” “Confirm,” or any similar button on the tipping page, or by otherwise completing a tip payment through the Service, you (the “Payer”) accept these Terms. If you do not agree with these Terms or with our Privacy Policy, please do not proceed with the payment. The Service is intended for use by guests of Venues who wish to reward a Worker who served them. By using the Service, you confirm that you have reached the legal age required under the laws of the country in which the Venue is located to enter into this kind of transaction.

The Service allows you to:

  • leave a voluntary Tip to a specific Worker;
  • view the Worker's public profile page, where shown by the Venue;
  • leave a rating or comment about your experience, where this feature is enabled by the Venue.

Definitions

Platform – the RESTOBOT website, web pages, and any related technical infrastructure through which the Service is offered, including pages at subdomains of restobot.pro.

Service – the functionality enabling a Payer to leave a cashless Tip to a Worker via the Platform.

Payer – the guest who uses the Service to leave a Tip.

Worker – an individual (e.g., a waiter, bartender, barista, host, or musician) who provides services at a Venue and who receives Tips through the Service.

Venue – the restaurant, café, bar, or other hospitality establishment, operating as a RESTOBOT Partner, at which the Worker provides services.

Tip – a voluntary monetary amount transferred by the Payer directly to the Worker through the Service. A Tip is not payment for goods or services and does not create any contractual relationship between the Payer and RESTOBOT or the Venue.

Payment Service Provider (PSP) – Stripe, specifically Stripe Payments Europe, Ltd. and its affiliates ("Stripe"), the licensed payment institution that processes the Tip payment and settles funds to the Worker's own Stripe-connected account. Stripe's terms are available at https://stripe.com/legal

Processing Fee – the fee charged by Stripe for processing the Tip payment, in accordance with Stripe's then-current pricing.

1. How the Service works

The Service enables you to leave a Tip directly to a named Worker.

The Tip is processed through Stripe and is paid out to the Worker’s own Stripe-connected account (Stripe Express).

RESTOBOT does not hold, receive, or take custody of Tip funds at any point: the Tip is charged directly to the Worker’s connected account, and the funds belong to the Worker from the moment the payment is authorised.

RESTOBOT is not a party to the payment relationship between you and Stripe, and is not a party to any relationship between you and the Worker or the Venue.

RESTOBOT’s role is limited to providing the technical webpage and infrastructure through which the Tip is initiated.

RESTOBOT is not an aggregator of tipping platforms and does not operate a marketplace: each tipping page is specific to one Worker at one Venue.

2. Fees

RESTOBOT does not currently charge the Payer or the Worker any service fee for use of the Service.

If RESTOBOT decides to introduce a service fee in the future, the fee amount will be clearly displayed to you before you confirm payment, and your continued use of the Service after such disclosure will constitute acceptance.

Independently of any RESTOBOT service fee, Stripe charges a Processing Fee for handling the payment.

Under RESTOBOT’s current payment architecture, the Processing Fee is deducted from the amount received by the Worker, not added on top of the Tip amount you pay.

This means the amount you pay is the amount charged to your card or other payment method, and the Worker receives that amount less the Processing Fee.

You may also incur charges from your own card issuer or bank, depending on your agreement with them (for example, foreign transaction fees).

RESTOBOT has no control over and is not responsible for such charges.

3. Nature of a Tip

A Tip is a voluntary gift to the Worker and not consideration for any goods or services.

Leaving a Tip does not entitle you to any goods, services, discount, or preferential treatment, and is not refundable except as set out in Section 4.

Tips are not processed by, and do not pass through, any account belonging to the Venue or to RESTOBOT.

The Venue is not a party to the Tip transaction.

4. Refunds and disputes

Because a Tip is a direct, voluntary payment to the Worker and is not payment for goods or services, Tips are generally non-refundable once processed, except where required by applicable law or where Stripe’s own dispute and chargeback mechanisms apply. If you believe a Tip was made in error (for example, an incorrect amount or a payment to the wrong Worker), please contact us at [email protected] as soon as possible.

We will assist you to the extent technically possible, but any refund of a Tip already paid out to a Worker’s Stripe account depends on the Worker’s cooperation and on Stripe’s applicable rules, since RESTOBOT does not hold the funds and cannot unilaterally reverse a payment that has already settled to the Worker.

Chargebacks and disputes relating to card payments are handled in accordance with Stripe’s standard dispute process.

RESTOBOT will provide reasonable assistance but is not the payment processor and cannot guarantee a particular outcome.

5. Data processing

To process your Tip, certain data (such as the payment amount, payment method details, and, where applicable, your name or contact details if you choose to provide them, for instance when leaving a comment) is transmitted to Stripe.

Stripe acts as an independent data controller for payment processing purposes, and its processing of your data is governed by Stripe’s own privacy policy.

If the Service allows you to leave a rating, comment, or feedback, that content may be visible to the Venue and, where the Venue enables it, displayed publicly on the Worker’s tipping page.

Please do not include personal data about yourself or third parties in such comments unless you intend for it to be seen.

RESTOBOT processes limited technical data (such as device and browser information) to operate and secure the Platform.

Service-related messages, such as a payment confirmation, may be sent without separate consent because they are necessary to perform the transaction you requested.

6. No guarantee of availability

The Service is provided “as is” and “as available.” RESTOBOT does not guarantee uninterrupted, error-free, or continuous availability of the Platform or the Service.

The Platform may be temporarily unavailable due to maintenance, technical issues, or the unavailability of third-party providers, including Stripe.

RESTOBOT may change, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice.

7. Limitation of liability

To the maximum extent permitted by applicable law, RESTOBOT shall not be liable for:

  • (i) the Worker’s conduct, the quality of service provided by the Worker or the Venue, or any dispute between you and the Worker or Venue;
  • (ii) the availability, performance, fees, or any act or omission of Stripe or any other third-party provider;
  • (iii) loss of profit, loss of data, or any indirect, incidental, special, or consequential damages arising from your use of the Service;

(iv) any payment made to the wrong Worker as a result of a QR code or link being displayed incorrectly by the Venue.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under applicable law, including liability for gross negligence, wilful misconduct, or rights granted to you as a consumer under EU or Polish consumer protection law and the GDPR.

8. Complaints

Complaints regarding the Service may be submitted to [email protected].

Please include a description of the issue, the approximate date and time of the Tip, and, if possible, the Venue and Worker concerned.

RESTOBOT will review and respond to complaints within a reasonable time, and in any event within 30 calendar days.

9. Changes to these Terms

RESTOBOT may update these Terms from time to time.

The version in force at the time you make a payment is the version available at www.restobot.pro/tips/legal at that time.

Material changes will be reflected by updating the “effective date” below.

10. Governing law and disputes

These Terms are governed by Polish law and applicable European Union law.

Any dispute arising out of or relating to these Terms shall be subject to the jurisdiction of the courts having jurisdiction over RESTOBOT’s registered address in Warsaw, Poland, without prejudice to any mandatory consumer-protection rules that may grant you the right to bring proceedings before the courts of your own place of residence.

If you are a consumer resident in the EU, you may also use the European Commission’s Online Dispute Resolution (ODR) platform.

11. Force majeure

RESTOBOT is not liable for any delay or failure to perform caused by events beyond its reasonable control, including failures of Stripe or other third-party infrastructure providers, internet or telecommunications outages, natural disasters, war, or governmental action.
